Contingency Search

Contingency searches can be done on an exclusive or non-exclusive basis. In most cases employers have developed a job description and associated experience requirements. Attorney Search Consultants, LLC then conducts a search based on those requirements, screens prospective candidates and refers those qualified for the opportunity to the client company or law firm. The employer conducts the interviews and selects the right candidate. The fee is contingent on the successful hire of a candidate who was referred by the firm. Clients often use multiple methods of recruiting in addition to engaging search consultants.

The benefits of contingency search include the flexibility to use various methods of recruiting candidates and use multiple agencies without incurring substantial added costs. Contingency searches are particularly useful in situations where an employer will only hire if a certain type of candidate becomes available and the search is not extremely urgent.

Retainer Search

Retainer searches are used primarily in situations where the employer is interested in completing the search in a particular timeframe or in instances where the position is senior and therefore urgent and the employer wants to see certain consistent progress throughout the search. Retainer searches are also used where the search is particularly difficult either because of a lack of abundant qualified potential candidates or for other reasons. Retainer searches assume a high level of commitment on the part of both the employer and search firm. Retainer searches are usually done on an exclusive basis, as this type of search requires an upfront payment for service. Fees are usually paid in installments including an initial fee at the beginning of the search, at an agreed upon mid-point and at the successful completion of the search.

Retained searches usually entail a search with a national scope but can be tailored to the client’s circumstances. Retained searches require written agreements and upon acceptance, priority is given to that search.
